Dubai deporting foreign workers based on flawed TB screening policy

It is sending back people whose chest X-rays show scars even though this is far from conclusive proof that the person has the disease

Charanjeet Singh, 31, was deported from the United Arab Emirates in February 2013 because a medical test showed he had a scar on his lung. He was permanently banned from the country. He had secured a job in Dubai as a credit collector at a law firm.

Singh had worked in Dubai earlier, from 2006 to 2011, for three different companies, and had passed the medical test each time he started a new job. But the fourth time, the authorities told him he had tuberculosis and sent him home.

Singh, who now lives in New Delhi, said that he did have a lung scar but has never had TB or exhibited symptoms typical of the disease, such as a fever, a persistent cough and night sweats. The lung scar, he said, was the result of a previous respiratory infection unconnected to TB.

His isn’t an isolated case. Over the past two years, the UAE's TB screening policy for foreign workers has become increasingly aggressive, targeting not just those with active tuberculosis, but anyone with a lung scar.

The scale of the deportations resulting from this policy is difficult to estimate because UAE authorities were not forthcoming. The country's Mumbai consulate said Scroll.in should email the health ministry, but neither that ministry nor the immigration ministry responded to email queries.

But cases abound. Singh has uploaded a petition on change.org, an advocacy website, urging the International Labour Organisation to challenge the UAE's policy. The petition has gathered nearly 5,000 signatories, including at least a dozen people who have posted comments saying they had had the same experience. Others have contacted Singh privately, he said.

The deported employees have faced considerable hardship. They had given up jobs at home, taken loans to travel to the UAE and made financial commitments based on the salaries they expected to earn from their positions in the Gulf.

"I went to into depression on my return," said Singh, who has not yet been able to find a job to his liking in India. "My father had suffered a paralytic stroke and I needed the money that I was earning in Dubai for his treatment."

Scroll.in spoke to six people across India, including Singh, who said they had been sent back from the UAE because of lung scars. Three said they had been permanently banned. The four who were in white-collar jobs eventually found work on their return to India, but said they had had to take huge pay cuts. The fifth was a homemaker who had to return to India with her son in October, leaving her husband behind in Dubai.

Lung scars

A lung scar can show up on a chest X-ray for several reasons. It is likely to show up for those with active tuberculosis — people infected with the TB bacillus who exhibit symptoms. Previously Gulf countries would send back foreign workers with active TB, fearing that they would spread the infection, said Dr Mario Raviglione, director of WHO's global TB programme.

But of late, Gulf countries have not been deporting foreign workers found with active TB but are treating them — in line with good public health practice, said Raviglione.

Ironically, while the UAE has mostly stopped sending back foreign workers with active TB, it is now doing this to people with lung scars but with no symptoms of TB.

For such people, a scar could be the result of an earlier case of active TB that has been cured, a sign of an earlier respiratory infection unrelated to TB or a sign of aggressive latent TB that the body has contained.

People with latent TB have been infected by the TB bacteria but are neither ill with the disease nor able to transmit it. Such people have a lifetime risk of only 10% of falling ill with TB, according to the WHO. About one-third of the world's population, or more than two billion people, have latent TB.

The job of health authorities, then, is to ascertain to which category the person belongs because this will determine whether the person is at risk of developing active TB and infecting others.But one cannot usually ascertain this merely by looking at the scar; the doctor must also clinically examine the person and review his or her medical history.

"From a scientific viewpoint, it makes little sense to consider at risk someone with a scar from a previous TB infection and has been completely cured," said the WHO's Raviglione. "This person is as much at risk of getting TB as anyone else."

Three of the six people that Scroll.in interviewed said they fell in this group, including New Delhi-based Deepika Rakesh, 24, who was sent back from Dubai in May 2012. She had TB when she was 13 years old and had been treated for it, she said.

In a letter written in October to US-based non-profit Treatment Action Group, Dr Jaouad Mahjour, a senior regional WHO director, admitted that health authorities in Gulf states were "fully aware that individuals with old TB scars...are not infectious...Nevertheless they had several arguments hindering them from changing their screening policy." The non-profit began investigating Singh's case after seeing his petition on change.org.

Determining what to do with people who have lung scars but no TB symptoms and no past history of the disease, however, is less straightforward. The scars could be from a previous respiratory ailment other than TB, as Singh and Mumbai-based Prashant Kamath, 38, a former director in a multinational bank in Dubai who was sent back in February 2012, claimed theirs were. But the scars may also signal an aggressive latent TB infection that may become active.

The sound response is to offer both groups prophylactic treatment, said Raviglione. "It is not public-health-minded to send back people you think are at risk,” he said. "Every doctor has a responsibility to cure people with TB not only for their sake but also to prevent transmission."

hello, i would like to share my experience. Last year i lost everything, i got married and my husband joined me in dubai. He got job offer with emirates airline passed all interview, got the job, even started working. He did the medicals and they discovered a spot on his lung. He was never sick never follow any treatment. He came back to my country did test again there is nothing its not tb but still when he came back to uae. They deport him he ws not accepted. I just took an appartment i lost everything money.job, dreams, life and we were just married. its inhumane and still it breaks my heart pls if u have spot in ur lung dont go to dubai thanks

I m never suffered t.b and any disease.I complete checkup in dubie from nmc hospital.reports are perfects.every thing is oki.I m nt suffer any kind of disease.sing show old infection nt tb and any big diease. I m fully alright and healthy. bt health authority can not give me fitness certificate.and life ban frm United arab emirates. plz tel me what I can do because me whole life money wast in u.a.e now I m too much worried I m nt go bach there.one sing issue ban from u.a.e. I hav complete tests reports.

Hello everyone, I was diagnosed with a heavy chest congestion(beginning of TB) in 2011 and after taking proper medications for 6 months i was completely cured back then. I got married last year and this year came to UAE and found a job. After the medical test they found a scar(fibrotic band) on my upper left zone of the chest and asked me to go for sputum test(which has to be given for 3 days). I am extremely happy to inform that my medical test result is clear and they have issued a fit certificate after my sputum tests were negative. So i am really hoping and believe that UAE has afterall changed their cruel laws which earlier never allowed any kind of scar or tb cases. Now they are reviewing on case to case basis so still some hope for whoever is going through the same. Good Luck to you all..

Hi! Same case. Recently last Month June, I had this Pe-employment medical exam back in Philippines for job in Abu Dhabi. And I was told that have this Lung Scar. I have encountered this back in 2012 in Qatar, undergone those sputum, skin test etc, successfully I passed and was given a Residence visa. Then on 2013 I transferred to Singapore. Now I am here in Abu Dhabi for a one week work (July 01 to 07), an assignment by my present employer in Singapore. I wanted to take this opportunity to take a personal x-ray test etc, but I don't know which facility should I go, that they can correctly assess whether my results will pass the UAE Immigration requirements, for Residence Visa. At least I can still look forward in the future if still I can look and get a job here in UAE. Please advise mga kababayans.

Hi there, After my medical test, capitalhealth screening center located in abu dhabi requested me to come back for sputum test because they saw scar in my both lungs. I never have TB before and no symptoms at all. (1) If result is negative, will they issue me fit to work clearance and disregard my xray result? (2) If result says latent TB (inactive), is there a chance i can still work here in uae? (3) If positive, i know i will be deported, should I leave the country before they deport me or wait until result? I am new here so I dont know the laws and rules as my friends told me that it keep on changing. Please advice what are my best options here. Thanking u in advance.

Hi Shalini I had same issue but I got approved medical certificate to process stump visa and I got the visa as well based on below comment. 1. My PRO convince to doctor that I have been staying for quite long in UAE(like 10 years) and never had such as issue. 2.MY PRO provides all my previous stump visa and in/out details to hospital. 3.I never had such as issue pass 9 years. 4.I did not get out of the country since last one and half years. 5.My TB scar is non active (Old TB). 6.I agreed with hospital to come do the check up every 3 month for 2 years (It's free of charge) Good Luck

Hello, Can someone help me in replying as my husband has been asked for sputum test and blood test but there was a scar found on his x-ray .but today when he went for medical report collection doctor asked him did he ever had TB before as he never had TB so replied no.Before that they asked him to register for health registration id and they ask him to come with company PRO on tuesday for collection of reports, As we already did a test here in dubai healthcare city and all his tests are negative. Should be consider this as positive for getting visa in Dubai as he has been ask for health ID registration by the nurse which he did before meeting the doctor and doctor seemed pretty cool and OK but didnt share the results asked to bring company PRO for collection.

Mga Kabayan! Me also!! I don’t have any history of tb before! Last week of May 2015 the company which I’ve been working few days ago they immediately cancel my contract in a matter of seconds because the PRO when he go there on the immigration to process other visa, then the immigration told to the PRO that I have problem in my medical (OLD TB).. This is very traumatic!! Experience I feel half of my life was destroy and my dreams to help my family back to our country and to have a better future is gone!! luckly thanks God I have 2 sisters here in dubai, friends and two of those know how to speak Arabic. We try different kinds of way to save my case.. Right know the only one good things to do is go there on the immigration with prepared things, plane ticket and feeling that I need to exit here and Dubai, but I consulted on the Pulmonologist here and xray again, I have all the documents to show to the immigration to save my case and they will not put me on the blacklist! Inshallah 2nd week of July 2015 good things come up! ,

We all have the same problem! Lung scar is really an issue on all the gulf country! Never ever try it or else you'll be depressed! Singapore is the place to be! Securing a working pass even with lung scar is easy as long as its not active. You'll of course undergo a series of test, like blood, skin and sputum. But if all tested negative then you are fit to work. Don't be depressed guys, i am sure there are still many countries out there that will accept us! Cheer up!

I went to Abu Dhabi last February 2014 and after two weeks a got a very good job good salary. When my employer process my visa they told me that I need to go back to SEHA because they found something on my chest x-ray.I don’t have any cough, fever or flu. SEHA get my 3 sputum test, blood test and skin test all are negative but still they send me to ALRAHBA Hospital because they needed to isolate me for confirmation purposes,I have been in the hospital for 14 days all test are given again, chest x-ray, and sputum test.a day before I am going out to the Hospital my employer called me up telling me that they will let go of me because it took me so long to the hospital they will get another person for my position,I beg to my boss that please wait for the last result but then they made their decision already.When I go out to the Hospital, I talked to my employer to please give me certificate that does not put me in Labor ban, they gave me certain documents, then I try looking for a job again,again I got a good job in Musafah and also the employer gave me good salary also because I have a good experience. Now my new employer process my papers again, I went out of the country for my exit then go back again in UAE, on the process of my Visa, SEHA called me up and telling me why I am still in the UAE, I asked them why? Somethings wrong they told me that I should be deported because of my first medical in my first job, but I question them why do they still accept me in the second time when I enter the DUBAI Airport if in the system I am to be deported. But still they insisted that If they found scar or something in your x-ray you will be deported. The Health Authority talked to me also, I told them why are they doing this? They put me to hospital for confirmation of what they are saying that I have scar but when they got all the result from my laboratory and all are negative still they insisted the fact that somethings wrong with me. Meaning the process that they are doing for confirmation in not legible, because they will still depend on the x-ray. The Doctors from ALRAHBA helped me also, because they are the once who assisted the SCAR patience telling me that why I am to be deported, they advices me to get my documents or records from the hospital and showed it to SEHA to support that I am really okay, maybe it is just the reading of x-ray laboratory who is wrong. But then the SEHA had a final decision that I will be deported. I feel very bad because I spend too much already for my exit and everything I borrowed money to my friends just to support my expenses but still I did fail. When I go back to Philippines I went to big Hospital, they tested me and even x-ray me but they found out nothing. They give me all the test but still all are negative, this is so bad, maybe there is something wrong in their laboratory operator that the result is read wrongfully by SEHA. I hope they consider this kind of issue after all I don’t have any history of TB.

I have working in Dubai and Abu Dhabi for 10 years and everything went well whenever visa is renewed or change new job, but in this current new job in January 2015, start issue and found scar on my lung because of non-active TB and has to do check up 3 days sputum etc., but fairly I got visa approval ( Thanks for my PRO who is trying every possibility ways to get approval), but I had sign with hospital that I will come back and do the test every 3 month for 2 years, now, first round is done and went well. Thanks God and this will continues.

Hi, Scar is not a big problem, if you do not have active TB. It happened with me also jus a week ago in Dubai. They find a scar on my lung and asked me for retest, that includes sputum and blood test. I gone through the retest and it was negative. Hence they issued me a fitness certificate. But it is important that you speak to the doctor in detail. The doctors, are not professionally well here. so keep in mind you will have to fight with them. Above all if you have your fate here in Dubai you will be clear, if not, nobody can clear you. It is decided by Allah and He always choose the best for his creatures.

I am facing thesame problem. We are all in thesame boat. I was diagnosed of having minimal ptb last year in PH. I knew I had the disease when I took my pre-employment med exam bound for KSA as a nurse. Unfortunately, I was UNFIT to work due to Lung scar. I sought second opinion at Lung Center of the Philippines and I found out that I have minimal PTB and advised to take 6 months treatment. I accepted my fate and put my trust to God that this too shall pass. I finished my treatment last March 2015 and the scar in my lungs remained. My family encouraged me not to give up and life must go on and look for another employment opportunity in Dubai. I previously worked in KSA before for 2 years and no lung scar was seen. After knowing that I got PTB, i was so depressed that I felt that the world is tumbling down on me. I was reluctant to pursue my dream to work abroad but my family has been very supportive and they told me to give it a try and if worse comes to worst, I will be returning back to my home country. Now, I am in Dubai as a Tourist and I have applied a job recently and has been offered to work. I am a bit nervous because I don't know what's goanna happen if they found out that I have lung scar. I put my trust in the Lord and I cast all my worries to Him. I know everything has a purpose and ther is a reason why I am here now. I just need to wait and trust. I will keep you posted after I have undergone my medical exam.

had the same story. 2013 when i was there its my first time actually to work abroad. When the result was given to my boss that i have an OLD TB SCAR we went to dxb immigration, i had eye scan. They issued a form with my name and there is no anything written besides the column of TYPE OF BAN and VALIDITY OF BAN. So we thought me and my boss that i am not banned. So i just need to be out of dubai before my working visa will expire. But after 6 months my aunt who is working as visa agent tried to applied a tourist visa for me, it shows in the system that i am banned to enter dubai for a life time.can anyone helped me to know the answer why they did not put anything in the form indicating my ban then afterwards they ban me for life to enter dxb.

Dear All, I was in gulf country almost 6 years last i was in abhudhabi 2011 t0 2013 after i resigned came by country i got one job in oman 6 month bfore i went GAMCA MEdical they rejected due to Scar in lungs (i wont affedced any dieasea like TP ETC). Recently i got one job in abudhabi thorugh my friend that company did not ask any medical test in india they issued residential visa , I GOT FEAR if i went medical abudhabi they found scar in my xray is it any problem or company will take care because they wont ask any medical in india (i was in uae 2 year) please help me any one

I strongly suggest eveyone not to go to dubai if u have a lung scar because they will just diagnOsed you for having a tb. One more thing that everyone needs to know about being unfair of the officers inside muhaisnah is that I was with another lady having the same issue and undergo sputum and blood test but since she didnt go back to our country after her finished contract, she didnt undergo skin test, but during those days that we were having a retests, this lady kept on coughing too much not to mention that this lady is so beautiful. I took her mobile Number so we could chat about our results. I was just surprised and felt dissapointed that she passed her medical test. Dissapointed because she told me that everything happens so fast. She took their PRO to mUhaisnah to get the result. while inside the office the PRO and the officer were talking in arabic kept on exchanging words and opinions and after that they Got the medical result that says physically fit.. see? Fantastic job officers at muhaisnah clinic. I pray to God that you people must be equal to everybody. That's all thank you

Hi. I had the same experience. I worked in dubai from 2008 to 2011 and my medical test was ok. From 2012 to 2013 i worked in another company and again my medical test was ok. I went back to my country after my resignation but when I came back to Dubai last year 2014 and need to take the medical test for my new job my medical test failed. They said that i have a lung scar so i undergo sputum test for 3 times plus blood test. When i went back there for the result they said all the test is ok but since the officer inside the office (muhaisnah) said that i was out of UAE for 5 months I might get infected with tb so I need to undergo skin test and doctors inside checked me and all is ok. I was hoping that day that since my tests were ok (negative) I will pass the test and will get a physically fit result but I was told to go home and should inform the PRO to collect my rsult.. after the long wait the PRO told me that i failed the test and its written there that i Have old tb spot need tk be deported And got a lifetime bann See the inhumane rules of the ministry of health in dubai?absolutely UNFAIR!!! That was not so easy to come back in muhaisnah everyday for the fact that i lived in karama. Very far from that place i even paid big amount for taxi just to come back for retests got negative results but after that will diagnosed with an old tb spot. I never had tb and never had medicines to cure such disease so how come?

hi i am abdul . previous i was working saudiarbia. that time my medical test fit. after 4 years i was affected cold and cough. i didnt take proper medicine. after i came vacation india here i took all medicine properly now my health is good now normal condition. but after treatment i take x ray and blood test everything is normal. but x ray only lung scar fully there. doctor told ur health is fit. but that scar didnot remove. last 1 year before i went qatar and take medical test but qatar ministry told unfit i come back qatar. now i am looking for job. anybody help for me. which countries allowed for expect x ray. kindly suggestion for me. my mail id abdulmohd11987@gmail.com

I just read all the comments, stories and i have the same feeling of depression. I am currently in Muhaisnah medical center with same story. I am feeling very well not coughing no flu and no sign of illness. I came in Dubai on 2010 with my wife and passed all my medical test with my previous company, now i am joining with new company. After two months joining they finally process my medical in karama, a day after the PRO told me that the result is failed, they said i have minor spot in my lungs so they told me to go in Muhaisnah medical for sputum for three days. On the third day, they ask me to go in block 9 to see the doctor but once i came inside the guy told me that i have active TB and they will cure me in the isolation. I told him that i am not ill nor felling anything bad and im physically fit! We dont have history of TB, i insist for retest but they ask me to stay here. Now i am facing deportation after two weeks, the government of dubai really needs to see this kind of dilema, they can actually give some medical certification for those old residents and agreed to take follow up check up for security.

Hi I m also the victim of tb scare i was deported in june 2014 for lung scar never had a tb i did retest in my country no active tb just only scar dubai govt had to think about it many people including me loosing good career

Hi I m also the victum of tb scare.they deport me by saying that newcomer are not allowed with tb scar. My blood report is fine .And I don't have active tb.but just a scar.and they deport me.i have one year old girl. I com back to my home country and all the time pray to God give some marcy in the heart of them.and they chang the rule.no one is hear to look after us axpect him Tears are in my eyes while writing this post

I am a Filipino Nurse and end up stuck here for just a scan brought abou by a previous Pnuemonia. Even a negative AFB (sputum exam). Nevertheless, due to some fibrosis brought by the infection. I wasn't able to secure a fit to work. I worked in Doha 2 years back and never encounther such dilemma. This is really an unfair treatment to such manifistation that is far away from the real cause.

to above frens who r waiting for report i would say they will send you back to home.my case was same as yours.scar in chest was found.i never had tb or any problem.and you will get a report with ban written in it not mentioning anything is it for lifetime or for some years

I was deport in 24 march 2014 for the reson of old tb scar yes I have a scar bt I am healty and fit so how can the goverment mention in my report I am unfit how can he say I came in dubai of housewife visa and I live with my husbnd last 3 year and he not infected to live with us he fit and fine and very happy bt the Gcc rule is say that when the scar person come in her country the country is infected to tb and other infection how can he say that he dont undustude our feeling My husband is working in abudhabi last 8year as Engineer After my medical report we are shocked and mentaly depresed and I retun back my country and I dont dont want to live without my husband Evry Namaz I said to god please please change this rule which rule who break many heart many dream and forse to live without your life patner please please read our massege and think deeply about our feeling and Please please please please please change this rule anx give me chance to come back your country

i am also facing similar issue, they have found something in my chest x-ray and called me again for 3 sputum test along with blood test at Muhaisnah Medical Fitness Centre ..they have called me after 2 days ..can anybody tell me what happens after this...when do i get my final report ?

I am also facing such issue, they have found scars in my lungs after x-ray and called me again for 3 sputum test along with blood test and past history was noted by physician... Now i am waiting for decision to come by their committee which will be informed to me through my company's PRO.

l was deported on the 25th of December 2014 because of old tb but l have never had tb before since of which l will go for a retest in my country.l went to the immigration and asked if there was a life ban imposed on me or some type of ban but they said,where its suppose to be written validity of ban doesn't specify and its not written anything so you can come back again. But still l'm not sure about this as l see people writting on the net that if you a diagnosed with this desease they ban you for life, do the health authorities tell you, who tells you or its written somewhere on the report from the hospital,who tells you?? please someone help.

Yes what Mr. Singh what told above is absolutely true. i am also the victim of same. i never Had TB in my life never took medicine also till now. and i am fit and fine. i was deported in 2008 for Lung scar. this lung scar was due to Phenomia in my child hood days and not because of TB. Dubai Authorites should change the rules

My wife was identified as a case of old and cured TB and was banned for life. I tried unsuccessfully for two years to try and get an exemption since it was a case of old TB. However, I was unsuccessful. I finally gave up a good job and am back in India. If possible, I would like to return to Dubai but not unless the law is changed.
